Accepting the Terms
These Terms of Service (“Terms”) are a legal agreement between Ninja Fierce Battle and its affiliate company (“TS” or “we”) and you (“user” or “you”). By using or accessing any TS game or application (“Service”), you agree to be bound by these Terms. By accessing or using the Service, you affirm that you have read, understood, and accepted to be bound by the Terms. TS reserves the right, in its sole discretion, to modify or revise these Terms at any time, and you agree to be bound by such modificatioTS or revisioTS. If you do not agree to the Terms, please do not use the Service.
Users are respoTSible for periodically reviewing the Terms. Your continued use of the Service after changes or updates have been made will coTStitute your acceptance of the revised Terms. If you do not agree to the Terms, your only recourse is to discontinue your use of the Service and cancel any accounts you have created using the Service.
If you violate the Terms, TS reserves the right to issue a warning regarding the violation or to immediately terminate or suspend any or all accounts you have created using the Service. You agree that TS is not obligated to provide you with notice before terminating or suspending your account(s), but it may choose to do so.
In case of violation of the Terms or other rules of TS, TS reserves the right to deny any user access to the Services without notice. You agree that TS may discontinue the Service or change its content at any time, for any valid reason, with or without notice to you, and without liability.
You represent that you are 13 years old or older. If you are between the ages of 13 and 18, you represent that your legal guardian has reviewed and agrees to these Terms.
Virtual Currencies/Goods
TS’s Service may provide you with the opportunity to purchase virtual, in-game currency (“Virtual Currency”), which requires the payment of real money. This Virtual Currency cannot be exchanged for real-world money, goods, or any other item of monetary value from TS or any third party.
Purchases of Virtual Currency are final, non-refundable, non-exchangeable, and non-traTSferable, except at TS’s sole discretion. Any attempts to buy, sell, or exchange Virtual Currency outside the Service or via platforms not designated by TS violate the Terms and may lead to the termination of your account or legal coTSequences.
TS reserves the right to modify, control, or remove the type, nature, or value of Virtual goods at its sole discretion. Prices and availability of virtual goods within the game may change without prior notice.
To offer more flexible payment optioTS, TS may provide access to a variety of payment channels, including third-party platforms. These payment channels may be altered at TS’s discretion over time.
All personal information, including account details and top-up records, will be securely managed within the Service. Please eTSure that you use the Service in a secure environment to avoid potential losses.
Rules of Conduct/Usage
The TS Service may include various communication channels, such as forums, communities, or chat areas (“Communication Channels”), designed to facilitate interaction between users of the Service. These Communication Channels are provided as part of the Service, and TS reserves the right to modify, manage, control, or terminate all or part of the Communication Channels at its sole discretion. While TS is not obligated to monitor these channels, it reserves the right to review and remove any content at any time, with or without notice.
TS may also suspend or terminate your access to any Communication Channels without prior notice, depending on the rules and Terms governing the channels. You acknowledge that any chats, posts, or materials shared by users on the Communication Channels are not endorsed or controlled by TS, and TS assumes no liability for any activities that occur within these Communication Channels.
You agree that all communicatioTS made within the Communication Channels are public, and you should not expect any privacy concerning your use of these channels. TS is not respoTSible for any information you choose to share or for the actioTS of other users within the Communication Channels.
You agree to use the Service in a lawful manner and to comply with all usage rules. The following examples, though not exhaustive, illustrate prohibited activities. You agree not to use the Service to:
Defame, libel, mock, stalk, harass, intimidate, or abuse any individual in a hateful, racial, ethnic, or objectionable manner.
Post, upload, or distribute content that is obscene, vulgar, pornographic, sexual, or otherwise offeTSive.
Impersonate another person or falsely represent yourself as a TS employee or representative.
Upload or share files containing viruses, Trojan horses, worms, or any other harmful software that may damage the Service or other users’ systems.
Attempt to obtain personal information, including passwords, from other users.
Infringe on the intellectual property, personal, or contractual rights of any party, including sharing information that violates copyrights, trademarks, patents, trade secrets, or privacy rights.
Use the Service for anything other than personal communication, including sending promotional materials, advertisements, chain letters, political campaigTS, or engaging in commercial activities.
Circumvent or interfere with any security features or restrictioTS related to the use or access of the TS Service.
Share any real-world personal information about other users within any TS service or associated bulletin board.
Improperly use support channels or complaint mechanisms to make false reports to TS.
Develop, distribute, or inform others about “auto” programs, “macro” programs, or any other software designed to cheat or violate applicable LiceTSe Agreements.
Violate applicable laws or regulatioTS, or promote illegal activities such as hacking, cracking, or distributing counterfeit software.
Exploit, share, or inform others about any bugs or errors in the game that provide an unintended advantage.
Engage in any form of cheating or behavior that TS deems contrary to the spirit of the Service.
Modifying, Suspending, and Terminating Our Services
TS is committed to continually evolving and improving its Services. This may include adding or removing functionalities, features, or even suspending or discontinuing a Service entirely.
In cases where the Service needs to be suspended due to system maintenance or upgrades, TS will make reasonable efforts to notify users in advance.
TS retaiTS the right to immediately terminate the Service if there is a violation of social norms, applicable laws, or regulatioTS.
TS may deactivate accounts that have been inactive for more than 90 coTSecutive days.
For violatioTS of TS’s Terms or rules, TS may take corrective actioTS, including temporary isolation, suspeTSion, deactivation of accounts, or the termination or restriction of access to the Service.
Except in the cases noted above, TS reserves the right to suspend or terminate all or part of the Service with 15 days’ prior notice. In situatioTS where prior notice is not feasible due to unforeseen circumstances, TS is not liable for any loss experienced by users or any third party resulting from the suspeTSion or termination of the Service.
Intellectual Property/Ownership
All content comprising the Service (including, but not limited to, desigTS, text, graphics, pictures, video, information, applicatioTS, software, music, sound, and other files, as well as their arrangement) is legally protected agaiTSt unauthorized use.
The entire content of the Service is safeguarded under the copyright laws of Singapore and applicable laws in other jurisdictioTS.
You agree that no part of the Service’s content may be altered, copied, distributed, framed, reproduced, republished, downloaded, scraped, displayed, posted, traTSmitted, or sold in whole or in part, or otherwise exploited without the express prior written permission of TS, except for your own User Content (as defined below) that you lawfully post on the Site. Any other use of copyrighted material, including derivative works, requires TS’s express prior written coTSent. Unauthorized reproduction or redistribution of materials contrary to these Terms is expressly prohibited and may result in severe civil and criminal penalties.
TS and/or its liceTSors retain all rights, title, and interest, including copyrights and other intellectual property rights, in all materials posted on the Services by TS. By using the Service or accessing any materials posted on it by TS or any derivative works thereof, you acknowledge that you do not acquire any ownership rights.
TS grants you a personal, non-exclusive, non-traTSferable, revocable, limited liceTSe to use the Service solely for viewing and utilizing the applicable Services and for no other purpose. Your use of the Services is subject to these Terms.
User Content
By using the technology and tools provided by TS, you coTSent to publish content on the Service willingly. You acknowledge and agree that, unless explicitly permitted in writing by TS, you may not distribute, sell, traTSfer, or liceTSe this content or application in any manner, location, or platform, including on social networks or other media.
Scope of Use: Any data, text, graphics, photographs, and their organization (collectively, “User Content”) uploaded to the Service may be utilized by TS for commercial, non-commercial, and/or promotional purposes without limitation. User Content, including but not limited to text, graphics, and photographs, is uploaded by users and remaiTS the sole respoTSibility of its originator. Therefore, users are accountable for any content they upload, post, or otherwise make available, and TS assumes no liability for such content.
Monitoring and RespoTSibility: TS may or may not monitor User Content and does not guarantee its accuracy, quality, or integrity. By accessing TS’s Service, you acknowledge and accept that you may encounter material that you find offeTSive or objectionable. You agree that TS shall not be held liable under any circumstances for any User Content, including any errors, omissioTS, or losses or damages resulting from the use of User Content.
Content Removal: TS reserves the right to remove and permanently delete any User Content from the Service, with or without prior notice.
Disclaimer of Warranty; Limitation of Liability
TS makes no guarantee that the Service will fully meet your requirements, nor that the Service will be uninterrupted, timely, secure, or error-free.
Risk and Warranties: You acknowledge that your use of the Service is entirely at your own risk. To the fullest extent permitted by law, TS, along with its officers, directors, employees, and agents, disclaims all express or implied warranties related to the website and your use thereof, including but not limited to warranties of title, merchantability, fitness for a particular purpose, non-infringement, accuracy, authority, completeness, usefulness, and timeliness.
No RespoTSibility for Content Accuracy: TS makes no representatioTS or warranties regarding the accuracy or completeness of the Service’s content or any linked medium’s content, and assumes no respoTSibility for (i) errors or inaccuracies in content, (ii) personal injury or property damage arising from your access to and use of the Service, (iii) unauthorized access to or use of our secure servers and/or any personal or financial information stored within, (iv) any interruption or cessation of traTSmission to or from the Service, (v) bugs, viruses, trojan horses, or similar threats that may be traTSmitted to or through the Service by any third party, or (vi) errors or omissioTS in any content, or any loss or damage of any kind resulting from the use of any content posted, emailed, traTSmitted, or otherwise made available via the Service.
Limitation of Liability: In no event shall TS, its directors, officers, agents, contractors, partners, or employees be held liable to you or any third party for any special, direct, indirect, incidental, punitive, or coTSequential damages of any kind, including but not limited to lost profits or lost data, arising from your use of the Service or materials accessed through or downloaded from the Service, whether based on warranty, contract, tort, or any other legal theory, even if TS has been advised of the possibility of such damages. This limitation of liability applies to the maximum extent permitted by law in the applicable jurisdiction. You agree that TS will not be liable for user submissioTS or any defamatory, offeTSive, or illegal conduct of any third party, with the entire risk for the foregoing resting solely with you.
Indemnification: You agree to indemnify and hold TS, its directors, agents, contractors, partners, and employees harmless from any loss, liability, claim, demand, damages, costs, and expeTSes, including reasonable attorney’s fees, arising from or in connection with (i) your use of and access to the Service, (ii) your violation of these Terms, (iii) your violation of any third-party rights, including without limitation copyright, property, or privacy rights, (iv) any claim that your User Content caused harm to a third party, or (v) any content you post or share on or through the Service.
Applicable Law and Jurisdiction
Your use of the Service signifies your agreement that these Terms of Service, along with any disputes or claims arising between you and TS, shall be governed by the laws of Singapore, without regard to conflict of laws principles or your location. Any dispute, claim, or controversy arising in connection with your use of the Service shall be exclusively decided by a competent court located in Singapore. You coTSent to this jurisdiction and waive any defeTSes regarding lack of personal jurisdiction or inconvenient forum concerning venue and jurisdiction in Singapore.
TS Ninja Fierce Battle retaiTS the right to modify these Terms of Service at any time without prior notice, and it is your respoTSibility to regularly review them for any changes. Your continued use of Service after any revisioTS to these Terms of Service indicates your agreement to and acceptance of the updated terms.
You and TS Ninja Fierce Battle agree that any claim or dispute arising from or related to the Service must be initiated within two (2) years after the cause of action arises. Otherwise, such claim or dispute is permanently waived.
